Since approval of the EU General Data Protection Regulation (GDPR) in 2016, it has been widely and repeatedly claimed that the GDPR will legally mandate a ‘right to explanation’ of all decisions made by automated or artificially intelligent algorithmic systems. This right to explanation is viewed as an ideal mechanism to enhance the accountability and transparency of automated decision-making. However, there are several reasons to doubt both the legal existence and the feasibility of such a right. In contrast to the (...) right to explanation of specific automated decisions claimed elsewhere, the GDPR only mandates that data subjects receive meaningful, but properly limited, information (Articles 13-15) about the logic involved, as well as the significance and the envisaged consequences of automated decision-making systems, what we term a ‘right to be informed’. Further, the ambiguity and limited scope of the ‘right not to be subject to automated decision-making’ contained in Article 22 (from which the alleged ‘right to explanation’ stems) raises questions over the protection actually afforded to data subjects. These problems show that the GDPR lacks precise language as well as explicit and well-defined rights and safeguards against automated decision-making, and therefore runs the risk of being toothless. We propose a number of legislative and policy steps that, if taken, may improve the transparency and accountability of automated decision-making when the GDPR comes into force in 2018. (shrink)

Biological knowledge does not fit the image of science that philosophers have developed. Many argue that biology has no laws. Here I criticize standard normative accounts of law and defend an alternative, pragmatic approach. I argue that a multidimensional conceptual framework should replace the standard dichotomous law/ accident distinction in order to display important differences in the kinds of causal structure found in nature and the corresponding scientific representations of those structures. To this end I explore the dimensions of stability, (...) strength, and degree of abstraction that characterize the variety of scientific knowledge claims found in biology and other sciences. The `fact' of pluralism in science is nosurprise. Yet, if science is representing andexplaining the structure of the oneworld, why is there such a diversity ofrepresentations and explanations in somedomains? In this paper I consider severalphilosophical accounts of scientific pluralismthat explain the persistence of bothcompetitive and compatible alternatives. PaulSherman's `Levels of Analysis' account suggeststhat in biology competition betweenexplanations can be partitioned by the type ofquestion being investigated. I argue that thisaccount does not locate competition andcompatibility correctly. I then defend anintegrative (...) model for understanding pluralism. This view is based on taking seriously both thecomplexity and contingency of biologicalorganization and the idealized character ofbiological models. On this view, explanationbecomes, among other things, the location forthe integration of diverse models. I explicatemy argument by an analysis of explanations ofdivision of labor in social insects. In this article I consider the challenges for exporting causal knowledge raised by complex biological systems. In particular, James Woodward’s interventionist approach to causality identified three types of stability in causal explanation: invariance, modularity, and insensitivity. Thomas Hobbes has been hailed as the philosopher of power par excellence; however, I demonstrate that Hobbes’s conceptualization of political power is not stable across his texts. Once the distinction is made between the authorized and the effective power of the sovereign, it is no longer sufficient simply to defend a doctrine of the authorized power of the sovereign; such a doctrine must be robustly complemented by an account of how the effective power commensurate to this authority might be achieved. (...) Nor is this straightforward: for effective political power can fluctuate, sometimes severely. In this light, the prevalent juridical reading of Hobbes’s political philosophy is inadequate. In 2011 members of the School of Philosophy and Theology at The University of Notre Dame Australia (UNDA) Sydney campus, designed two standards rubrics as part of a project aimed at undertaking research within the area of assuring graduate attributes and capabilities in Australian universities. The standards rubrics designed were oriented towards developing particular graduate attributes intrinsic to the Core Curriculum programme in philosophy, ethics, and theology; all students at UNDA are required to undertake this programme, which reflects a ‘liberal (...) arts’ or ‘liberal education’ approach to university education. In this paper, we engage in an institutional case study of this project, discussing the advantages and challenges of developing and using these standards rubrics with a specific focus on: how they have already been used, how we plan to use them in the continuing development of our Core Curriculum programme, and the particular challenges we face in developing standards rubrics within a ‘liberal arts’ or ‘liberal education’ environment. In doing so, we will attempt to demonstrate the usefulness of developing standards rubrics as a basis for careful and systematic review of our pedagogical approach, and curriculum and assessment design so as to assure the achievement of graduate attributes and capabilities. SummaryPhilosophic questions about the adequacy of our prevailing Western conceptions of rationality have emerged from the growing recognition that one cannot simply “add women” as objects of knowledge to the existing bodies of our social and natural knowledge. Recent research in psychology and in moral development theory suggests that our understandings of the rationality of human activity are distorted and obscured by systematically identifying as universally desireable, as Human goals, conceptions of the self, others, and the appropriate relationships between the (...) two which are distinctively masculine. The essay suggests some implications of these research findings for the ways philosophers think about “the problems of philosophy”, moral theory, the role of formality and abstractness, and the “rational reconstructions” of the history of science.RésuméDes questions philosophiques se sont posées, a propos de ľadéquation de nos conceptions occidentales courantes de la rationalité, du fait de la reconnaissance qu'on ne peut pas simplement ajouter les femmes comme objets de connaissance aux corpus existants de notre connais‐sance sociale et naturelle. Des recherches récentes en psychologie et en théorie du développement moral suggèrent que notre comprèhension de la rationalité de ľactivité humaine est déformee et obscurcie par une identification systématique, comme universellement désirables, comme buts de ľhumanité, des conceptions de soi, des autres et des relations entre les deux qui sont distincte‐ment masculines. The question, “Will science remain human?” expresses a worry that deep learning algorithms will replace scientists in making crucial judgments of classification and inference and that something crucial will be lost if that happens. Ever since the introduction of telescopes and microscopes humans have relied on technologies to “extend” beyond human sensory perception in acquiring scientific knowledge. In this paper I explore whether the ways in which new learning technologies “extend” beyond human cognitive aspects of science can be treated instrumentally. (...) I will consider the norms for determining the reliability of a detection instrument, nuclear magnetic resonance spectroscopy, in predicting models of protein atomic structure. O trânsito religioso é indicador de que os “modelos oficiais e religião” têm sido substituídos, ou coexistem com oferenciais religiosos cambiantes, respondendo à demanda dos sujeitos de fé. Os anseios de significação imediata dos sujeitos de fé encontram na “vagabundagem religiosa” sua atitude mais coerente. A vagabundagem semântica dos crentes infiéis é o elemento dinamizador do campo religioso moderno. No presente texto nos propomos a discutir o trânsito religioso de mulheres, suas motivações e as implicações dessa “andança religiosa” para a (...) concepção que estas têm a respeito do sagrado. Para tanto nos utilizamos e dados de nossa pesquisa de campo realizada para a Universidade Católica de Goiás no ano 2000 em Alto Paraíso – GO, bem como de dados obtidos em pesquisa que realizamos para a Universidade Metodista de São Paulo na cidade de São Bernardo do Campo – SP em 2003, como parte do projeto intitulado: “Religiosidade caleidoscópica – nomadismo espiritual: implicações de gênero”. Os resultados da pesquisa indicaram um trânsito maior das mulheres por força das representações de gênero. Palavras-chave: Trânsito religioso; Secularização; Gênero. ABSTRACT Religious transit indicates that ‘official models of religion’ have been replaced, or coexist with mutable religious references, answering the believers’ demand. Their desire for immediate signification finds their most coherent attitude in ‘religious nomadism’. Unfaithful believers’ semantic nomadism is the dynamic element of modern religion. This text discusses women’s religious transit, their motivations and the implications of that ‘religious walk’ to their conception of the sacred. The date used are from a field research for the Universidade Católica de Goiás, developed in Alto Paraíso - State of Goiás, in 2000, and from a research for the Universidade Metodista de São Paulo, carried out in São Bernardo do Campo – State of São Paulo, in 2003, as part of a research project entitled: “Kaleidoscopic religiosity – spiritual nomadism: gender implications”. Negri celebrates a conception of democracy in which the concrete powers of individual humans are not alienated away, but rather are added together: this is a democracy of the multitude. But how can the multitude act without alienating anyone’s power? To answer this difficulty, Negri explicitly appeals to Spinoza. Nonetheless, in this paper, I argue that Spinoza’s philosophy does not support Negri’s project. I argue that the Spinozist multitude avoids internal hierarchy through the mediation of political institutions and not in (...) spite of them; nor do these institutions merely emanate from the multitude as it is, but rather they structure, restrain and channel its passions. In particular, the required institutions are not those of a simple direct democracy. There may be other non-Spinozist arguments on which Negri can ground his theory, but he cannot legitimately defend his conception of the democratic multitude by appeal to Spinoza. (shrink)

Nous proposons dans ce volume une approche pluridisciplinaire du sens commun. Fruit d'un travail collectif organisé au CURAPP et dans le cadre du programme scientifique ASC, les articles ici présentés, par la diversité de leurs orientations théoriques et disciplinaires, contribuent à faire un état des lieux de la question. L'idée de sens commun est fréquemment utilisée et citée en sociologie, philosophie, linguistique, psychologie, sans qu'il en soit toujours proposé de définition ou d'analyse critique. Elle demandait un travail de définition et (...) de requalification historique et théorique, et de mise en rapport à des corrélats : la norme, le sens moral, le sens social, le sens critique. L'ouvrage vise donc la description, aussi précise que possible des formes et des normes du sens commun en tant qu'elles enveloppent des dimensions cognitives, perceptives, linguistiques, sociales et morales. Il apparaît vite que cette notion résiste à la simple analyse et que seule la superposition de différents points de vue permet d'en percevoir quelques contours. On ne sera pas étonné de la diversité des figures convoquées et de la variété des objets à partir desquels elle est manifestée et interprétée. L'intérêt du sens commun comme objet d'investigation philosophique est alors d'apparaître comme ce qui permet de reprendre de manière oblique certains questionnements classiques qu'il déplace. Ainsi de la question topique des formes affectives, linguistiques et sociales d'expression du sentiment, de l'ancrage de la moralité dans une nature humaine et dans une sensibilité partagée ou encore de la manière dont le sens commun permet de réinterpréter, dans l'histoire des sciences sociales, la question des liens entre action et critique. Translated by María Cecilia Padilla and Gonzalo Ricci Cernadas. Negri celebra una concepción de la democracia en la que los poderes concretos de los individuos humanos no se alienan sino que se agregan: una democracia de la multitud. Pero ¿cómo puede actuar la multitud sin alienar el poder de nadie? Para contestar esta dificultad, Negri explícitamente apela (...) a Spinoza. Sin embargo, en este trabajo, sostengo que la filosofía de Spinoza no respalda el proyecto de Negri. Por el contrario, argumento que la multitud spinozista evita la jerarquía interna por medio de la mediación de las instituciones políticas y no a pesar de ellas; de la misma manera, estas instituciones tampoco simplemente emanan de la multitud tal cual es, sino que estructuran, contienen y canalizan sus pasiones. En particular, las instituciones requeridas no son las de la democracia simple y directa. The concept of organizational justice is important to understanding and predicting organizational behavior. A significant development in the research literature has been the separation of distributive and procedural justice. While much of the research has focused on negative outcomes, this research attempted to verify the presence of both forms of justice in the context of positive outcomes. Subjects completed an instrument designed to measure their perceptions of distributive and procedural justice. The subjects also reported their satisfaction and sense of fairness (...) with their salary increases, their belief that the procedures to award the increases had been followed, and their level of information and agreement regarding the salary program. These measures, along with size of salary increase and gender were examined to determine their impact on the subjects' perceived level of justice. The data support the existence of the two distinct forms of justice, but suggest that procedural justice may, in turn, branch out into two aspects. One category involves being informed, and a second appears to deal with acceptance of procedures. A series of relationships are then considered. Significant gender effects were non-existent. Philosophical accounts of emergence have been explicated in terms of logical relationships between statements (derivation) or static properties (function and realization). Jaegwon Kim is a modern proponent. A property is emergent if it is not explainable by (or reducible to) the properties of lower level components. This approach, I will argue, is unable to make sense of the kinds of emergence that are widespread in scientific explanations of complex systems. The standard philosophical notion of emergence posits the wrong dichotomies, confuses (...) compositional physicalism with explanatory physicalism, and is unable to represent the type of dynamic processes (self-organizing feedback) that both generate emergent properties and express downward causation. ¿Es posible que un filósofo promueva, con el ejemplo, la violencia como medio para la resolución de conflictos? Sócrates, Descartes, Rawls, Wittgenstein o Jonas, entre otros, son casos de quienes terminaron por distintas causas enrolándose en ejércitos o participando de algún modo en diversos conflictos bélicos. Muchos lograron a pesar de ello no mezclar sus filosofías con algo ajeno a la misma. Este artículo se propone indagar en la _La filosofía de la redención_ de Mainländer a fin de detectar los (...) peligros que acarrea enaltecer el uso de la violencia, elevando el amor a la patria a nivel de sabiduría filosófica. Este aspecto será identificado como el más delicado de su pensamiento, lo que explicará por qué se prescinde aquí de calificarlo de filósofo y se aluda a él como pensador en la medida que ciertas reflexiones que resultan ser esenciales en determinadas materias pudieron terminar siendo contaminadas por un fanatismo nacionalista. Esto abrirá la posibilidad de pensar en un criptobelicismo de base en algunos aspectos de su obra. (shrink)
